Welcome to AriaMus. We are an online transcription and transfer service that offers our subscribers access to national and international music sheet and score transcripts. We have gathered the detailed terms and conditions here. We recommend that you carefully read such terms and conditions, since they are the guidelines for the use of our service.
These Terms of Use are also a resource for you to better understand how our service works, including the types of data we collect, how billing occurs, how we interact with you and other useful details about our services. You should be able to read these Terms of Use whenever you have questions about the service or if you want to know how something works. For your convenience, we have indexed the Terms of Use to facilitate navigation and access to areas of interest. We hope you enjoy your experience with Ariamus.
Please note that these Terms of Use include built-in hyperlinks that can only be accessed through our website, so if you are reading these Terms of Use on any compatible device (for example, Internet enabled game consoles or televisions), it may be that you need to access the site to view additional terms.
The Terms of Use state that all disputes between you and the AriaMus will be resolved by BINDING ARBITRATION. YOU AGREE TO WAIVER YOUR RIGHT TO GO TO COURT to claim or defend your rights under this contract (except in matters that could be brought to a conciliation court). Your rights will be determined by a NEUTRAL MEDIATOR and NOT by a judge or jury, and your claims cannot be taken in the form of collective action.

Acceptance of Terms of Use
These Terms of Use, which include our Privacy policy, are governing the use of AriaMus services, including all features and functionalities, instant downloads, user interfaces, our website, and all available contents. By using, visiting or browsing AriaMus, you are accepting and agreeing to be bound by these Terms of Use. If you do not agree with these Terms of Use, do not use AriaMus, including our website and our user interfaces.

Changes to the Terms of Use
AriaMus reserves the right to make, occasionally, with or without prior notice, exclusively and under our discretion, any changes to our Terms of Use, including the Privacy Policy. The most current version of these Terms of Use can be revised on our website, through the link "Terms of Use" located at the bottom of the pages. The most current version of the Terms of Use will replace all previous versions. We will do our best to publish previous versions on our website when the Terms of Use are updated. You can view changes made to previous versions of the Terms of Use that we have already posted by visiting our website and clicking here.

Privacy and Communication Settings
Any personal information sent through AriaMus will be subjected to our Privacy policy, whose terms are incorporated here. Read our Privacy Policy to understand our practices. The date of any changes made to our Privacy Policy will be specified at the bottom of the policy. By using our service, you are consenting to receive certain communications from our company. AriaMus can send, for example, newsletters about new features, special offers, promotional announcements and customer surveys, by email or other means. If you no longer wish to receive newsletters, other promotional announcements and/or non-transactional communications, simply use the name and password registered in your account to access the link "Manage communication settings" on the page "My Account", and uncheck the items to unsubscribe, or simply click on the unsubscribe link in communications we send by email.

Subscription and Billing
You can find details regarding your subscription to the AriaMus at any time by visiting our website and clicking on the link "My Subscription".

Billing
By starting your subscription to AriaMus, you expressly agree that we are authorized to charge you a monthly, quarterly, semestral or annual subscription fee (according to the contracted plan) based on the price valid on the day of contracting. Please note that prices and fees are subjected to change if you cancel and later wish to reactivate your subscription. The subscription fee will be billed at the beginning of the paid subscription period and each subsequent month / year, unless and until you cancel the subscription. Visit our website and click on the link "My Subscription" to check the start date of your next renewal period. We automatically charge your credit card registered in your PayPal account every month / year, on the day corresponding to the beginning of your paid subscription. Subscription fees are charged under a single payment transaction. If your paid subscription started on a day that don't exist on another month, we will charge you on the last day of that month. For example, if you started your subscription to AriaMus (or became a paying subscriber) by January 31st of a given year, your next payment date will be February 28th of that year, as billing will take place on that date.
PAYMENTS ARE NOT REFUNDABLE AND THERE ARE NO RETURNS OR CREDITS RELATING TO PERIODS PARTIALLY OR NOT USED. If you want to contract a different plan, you must cancel the current subscription and perform the same contracting process, but choosing the new plan of your choice.

Recurring Subscription
Your subscription to the AriaMus will be recurring according to the chosen plan (monthly, quarterly, semestral or yearly) unless and until you cancel it or it is terminated by us. You must cancel your subscription before it is renewed to avoid being billed for the next subscription period. We will charge such subscription fee through the “Subscription and Recurring Payments” service provided by PayPal service. As long as your payments are up to date, you will receive the title of PREMIUM User, and you will be able to download unlimited content available on AriaMus and benefit from the exclusive PREMIUM features.

Cancellation
You can cancel your subscription to the AriaMus at any time. WE DO NOT OFFER REFUNDS OR CREDITS RELATING TO PERIODS USED IN PART OR NOT USED AT ALL. To cancel, visit our website, click on the “My Subscription” link and click on the button "Cancel subscription".

Right to rescind a contract
We reserve the right to terminate or restrict your use of our service, without notice, for any reason.

Service Availability.
We are not responsible for temporary unavailability of the website, as well as of our files due to technical problems or crashes related to the hosting service and servers.
You will also be able to make sheet music/score requests to our team through the “Request Score” link available on your page. Unfortunately, we cannot guarantee that all orders will be fulfilled, nor do we set deadlines for them, moreover we reserve the right to reject, remove or edit such content at any time without prior notice. When your order is fulfilled and the score is made available, you will have a direct link to it on your “Request Score” page. We remind you that only subscribers with current payments will be able to download this score.

Passwords
The subscriber who created the account on the AriaMus and whose payment method is charged here is called the Account Owner. The Account Owner has access and control over his or hers AriaMus account. Account Owner control is exercised through the use of a password; therefore, to maintain exclusive control, the Account Owner must not disclose their personal password to anyone.
BY SHARING THE AriaMus PASSWORD, THE OWNER IS AWARE THAT HE OR SHE MAY HAVE HIS OR HER ACCOUNT SUSPENDED BY OUR TEAM AND HIS OR HER SUBSCRIPTION CANCELLED AT ANY TIME, WITHOUT THE RIGHT OF REFUND.

Warranty disclaimer and limited liability terms
ALL SCORES/SHEET MUSIC IN THE AriaMus ARE TRANSCRIPTIONS CARRIED OUT BY OUR OWN TEAM OF EXPERT MUSICIANS, HOWEVER THIS DOES NOT GUARANTEE THE EXEMPTION OF ERRORS, OMISSIONS AND DIVERGENCES FROM THE ORIGINAL ARRANGEMENTS. THE CATALOG IS AN EXCLUSIVE CREATION OF AriaMus, EXEMPT FROM ANY RESPONSIBILITY OR WITHDRAWAL DUE TO COPYRIGHT CLAIMS, FORESEEN THAT OUR FILES ARE OUR OWN EDITIONS THAT REPRESENT A DIFFERENTIATED MUSICAL POINT OF VIEW.

Your conduct and behavior within AriaMus

By accessing AriaMus, including the website and its user interfaces, you agree to use the AriaMus service, including all associated features and functionalities, the website and user interfaces and all content in accordance with all laws, current rules and regulations, including limitations on public display or other restrictions on the use of the service or content. In addition, you agree not to upload, post, email or otherwise transmit any material that contains viruses or other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any software, hardware or equipment, or telecommunications network associated with the service. You also agree not to interfere with the servers or networks connected to any part of the Ariamus or to violate any of the procedures, policies or regulations associated with AriaMus. You also agree not to impersonate another person when using the AriaMus services, to act in a vulgar or offensive manner while using the service or to use the service for illegal purposes.

Restrictions of use
You must be 18 years of age or older to subscribe to AriaMus. In some jurisdictions, the age of majority may be above 18 years old, in which case you must be that age to become a subscriber. Although individuals under the age of 18 are allowed use the service, they may only do so with the involvement of the parent or legal guardian, on that person's account and subject to our Terms of Use. Unless otherwise specified, AriaMus services and any content viewed through our services is for personal and non-commercial use, and we grant you a limited, non-exclusive, non-transferable license to access and enjoy our material. With the exception of the limited license mentioned, no rights, title or interest will be transferred to you. You may not download (other than by caching pages, or as expressly permitted by these Terms of Use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works or offer for sale any information contained or obtained in the AriaMus services, without our written consent. Any unauthorized use of the content of AriaMus will terminate the license(s) granted by us and will result in the cancellation of your subscription.

Anti-fraud policy
We advise users to only download sheet music they are interested in playing. To avoid being tagged as spam or liable for fraud and/or putting the whole collection at risk, be aware that randomly downloading too many scores in a short period of time may cause your account to be temporarily blocked.

Downloads
We count on you to make "fair use" of the collection available on this website, we believe in the passion of making, sharing and playing great music and we think you do too. The use of reverse engineering, robots (“bots”) or automated scripts to download material available in our collection is expressly prohibited. This practice will lead to the user's being blocked, possibly leading to their banishment and automatic cancellation of the subscription(s); not being entitled to any refunds of amounts already paid. Legally, the user moreover may still be liable for violating our terms of use.

Copyright Claim
It is the policy of AriaMus to respect the intellectual property rights of third parties. AriaMus does not allow any unauthorized reproduction or distribution of sheet music/scores or other copyrighted content. If you believe that your work has been reproduced or distributed in a manner that constitutes copyright infringement or is aware of any infringing material available on the service, please notify us through the "Contact" link located on the left side menu of our website.

Arbitration contract
You and AriaMus agree that any dispute, claim or controversy resulting from or related in any way to the AriaMus services, including our website, our user interfaces and these Terms of Use, shall be determined by binding arbitration, thus not in court. Arbitration is more informal than a lawsuit. Arbitration uses a neutral mediator instead of a judge or jury, and allows for a more limited survey than in court and is subject to very limited review by the courts. Arbitrators may grant the same relieves and punishments as a court. If you choose to seek arbitration, you must first send a statement to AriaMus through the website so that - within working 30 days - we can ascertain a solution for your case and resolve the situation in a more amicable manner.
